This Privacy Policy explains how Akarshana Infra Pvt. Ltd. ("Akarshana Infra", "we", "us", "our") collects, uses, shares, stores and protects your personal data when you visit akarshanainfra.com/fusion4oyster/ (the "Website"), submit an enquiry form, contact us by telephone or WhatsApp, or respond to our advertisements on Meta (Facebook and Instagram), Google or any other platform.

We process personal data in accordance with the Digital Personal Data Protection Act, 2023 and the Digital Personal Data Protection Rules, 2025 of India. For the purposes of that law, Akarshana Infra Pvt. Ltd. is the Data Fiduciary and you are the Data Principal.

In short: we collect your name, email address, phone number and the flat configuration you are interested in, solely so that a member of our team can contact you about Fusion 4 Oyster. We do not sell your data. You can ask us to delete it at any time by writing to akarshanainfrapvtltd@gmail.com.

1. Who we are

Akarshana Infra Pvt. Ltd. is a real estate marketing company based in Bengaluru, Karnataka, India. We market residential units in the project Fusion 4 Oyster, K-RERA Registration No. PRM/KA/RERA/1251/309/PR/271123/006435, situated at No. 680, Sy. No. 28, Attur Layout, Yelahanka, Bengaluru – 560064.

2.2 Data collected automatically

When you browse the Website we may collect standard technical information such as your IP address, browser type and version, device type, operating system, referring page, the pages you viewed and the time spent on them. This is collected through our hosting provider's server logs and, where you consent, through analytics and advertising cookies described in section 8.

2.3 What we do not collect

We do not ask for and do not want your Aadhaar number, PAN, bank account details, card details, passwords, or any financial information through this Website. Documentation of that nature is exchanged only at the point of an actual transaction, in person or through your advocate, never through this Website or over WhatsApp. If anyone claiming to represent us asks for such information online, do not provide it and contact us immediately on +91 88672 970 80.

3. Why we collect it and our legal basis

We process your personal data on the basis of the consent you give when you tick the consent box on our enquiry form, submit a lead form on Meta or Google, or contact us directly. We use it only for these purposes:

To call, SMS, email or WhatsApp you about Fusion 4 Oyster, including availability, pricing, floor plans and approval documents;
To arrange and confirm a site visit;
To answer questions you have asked us;
To keep a record of enquiries received, for our own internal business records;
To comply with legal obligations, including under RERA and applicable tax law.

We will not use your data for any purpose materially different from those listed above without asking you again.

A note on DNC / NDNC: when you submit the enquiry form you expressly authorise us to contact you on the number you provide, and that authorisation takes precedence over any Do Not Call or National Do Not Call registration on that number. This authorisation lasts until you withdraw it (see section 7).

We do not sell your personal data to anyone, and we do not share it with unrelated third parties for their own marketing. We share it only with:

Our own sales team and authorised channel partners working on Fusion 4 Oyster, so they can contact you about your enquiry;
The developer and/or landowner of Fusion 4 Oyster, where necessary to confirm availability, block a unit or progress a booking;
Service providers acting on our instructions — our website host (Hostinger), Vercel Inc. which runs the small piece of software that receives your enquiry, and Google LLC, whose Gmail service delivers the resulting notification email to our inbox and stores it there. These providers process your data only to pass your enquiry to us; they do not use it for their own purposes. Where enabled, analytics and advertising platforms (Google, Meta) as described in section 8;
Banks or housing finance companies, only if you specifically ask us to help arrange a home loan and only with the details you authorise us to pass on;
Legal, accounting or regulatory authorities, where we are required by law to disclose.

Where a service provider processes data outside India, that transfer is made in accordance with applicable Indian law.

5. How long we keep it

Active enquiries: for as long as we are in contact with you about the project, and for 24 months after our last interaction.
If you become a purchaser: for as long as required under RERA, tax and company law (generally 8 years from the end of the relevant financial year).
If you withdraw consent or ask for erasure: we delete your data within 30 days, except any record we are legally obliged to retain.

6. Your rights and how to exercise them

Under the Digital Personal Data Protection Act, 2023 you have the right to:

Access a summary of the personal data we hold about you and how we process it;
Correct data that is inaccurate, and complete or update data that is incomplete;
Erase your personal data, where we are not legally required to keep it;
Withdraw consent at any time (see section 7);
Nominate another individual to exercise these rights on your behalf in the event of your death or incapacity;
Grievance redressal — to have a complaint answered by us, and to escalate to the Data Protection Board of India if you are not satisfied with our response.

To exercise any of these rights, email akarshanainfrapvtltd@gmail.com with the subject line "DPDP Request", call +91 88672 970 80, or message us on WhatsApp at +91 94923 63871. We will respond within 30 days. There is no charge for making a request.

7. Withdrawing your consent

Withdrawing consent is as easy as giving it. You can do any of the following, and we will act on it without asking you for a reason:

Email akarshanainfrapvtltd@gmail.com with the words "Withdraw consent";
Reply STOP to any WhatsApp message from us;
Tell the person who calls you that you wish to be removed from our list.

On withdrawal we will stop contacting you and delete your personal data within 30 days, except where we are legally required to retain a record. Withdrawal does not affect the lawfulness of processing carried out before you withdrew.

8. Cookies and advertising technologies

The Website uses a small number of cookies and similar technologies:

Strictly necessary — required for the page to load and function. These are always active.
Analytics — where enabled, Google Analytics helps us understand how many people visit and which sections they read, in aggregate.
Advertising — where enabled, the Meta Pixel and Google Ads tag let us measure whether our advertisements led to an enquiry, and show relevant ads to people who visited this page. These platforms may set their own cookies and process data under their own privacy policies: Meta Privacy Policy and Google Privacy Policy.

You can block or delete cookies through your browser settings at any time. Blocking analytics or advertising cookies will not stop you from using any part of this Website.

9. How we protect your data

We apply reasonable security safeguards appropriate to the small volume and low sensitivity of the data we hold. The Website is served over HTTPS. Enquiry data is accessible only to the members of our team who need it to respond to you. We do not store payment or identity documents on this Website. In the event of a personal data breach we will notify affected Data Principals and the Data Protection Board of India as required by law.

10. Children's data

This Website and our services are directed at adults. We do not knowingly collect personal data of anyone under 18 years of age, and we do not carry out tracking, behavioural monitoring or targeted advertising directed at children. If you believe a child has submitted personal data to us, write to us and we will delete it.

11. Changes to this policy

We may update this Privacy Policy from time to time. The "Last updated" date at the top of this page will always reflect the current version. Material changes affecting how we use data already collected from you will be notified to you directly where we hold your contact details.
