These Terms of Use govern your access to and use of the website akarshanainfra.com/fusion4oyster/ (the "Website"), operated by Akarshana Infra Pvt. Ltd. ("Akarshana Infra", "we", "us", "our") in connection with the marketing of residential units in the project Fusion 4 Oyster.

By accessing this Website, submitting an enquiry, or contacting us through any channel linked from this Website, you confirm that you have read, understood and accepted these Terms. If you do not accept them, please do not use this Website.

1. RERA disclosure

All information on this Website is subject to the particulars registered with the Karnataka Real Estate Regulatory Authority. Where anything on this Website differs from the RERA-registered documents, the RERA-registered documents prevail. You are strongly advised to inspect the registered particulars on the K-RERA portal before making any decision.

2. No offer or contract

This Website and all its contents are for general information and marketing purposes only. Nothing on it constitutes:

• an offer or an invitation to offer;
• a contract, agreement to sell, or any binding commitment;
• a reservation, allotment or guarantee of any particular unit;
• legal, tax, financial or investment advice.

No booking, allotment or sale is effective except under a written agreement executed between you and the seller, duly stamped and registered as required by law. Any communication from us — whether by phone, WhatsApp, email or in person — is subject to that written agreement.

We compile the information on this Website in good faith from the project brochure, sanctioned plans and approval documents, and we take reasonable care to keep it current. However we do not warrant that it is complete, accurate or up to date at any given moment. Details may change without notice. Please verify everything that matters to you, in writing, before you act on it.

4. Images, renders and floor plans

• Interior photographs and lifestyle imagery on this Website are artist's impressions and representative visualisations. They may be digitally created or enhanced. They indicate the general character of a space, not the actual delivered condition, finish, furniture or fittings of any unit.
• Furniture, furnishings, appliances, décor, plants and accessories shown in any image are not included in the sale unless expressly listed in your written agreement.
• Floor plans are reproduced from the project documentation and are indicative and not to scale. Dimensions are approximate and subject to construction tolerances and final measurement.
• Where the project brochure contains any feature that is not present at the site, the actual site condition prevails. For the avoidance of doubt, this project does not have a swimming pool, notwithstanding any image or mention of one in older brochure material.

5. Pricing, availability and taxes

• The indicative rate of ₹9,500 per square foot and any derived total prices shown on this Website are exclusive of GST (where applicable), stamp duty, registration charges, legal fees, maintenance deposits, corpus fund, utility connection charges, and any other statutory or incidental charge.
• Prices are indicative and subject to revision without notice. The applicable price is the one stated in your written agreement.
• Availability shown on this Website (including the statement that four units remain) reflects our understanding at the time of publishing and changes frequently. Availability is confirmed only at the point of a written booking. Please call to confirm before travelling to site.
• Any indicative total price shown is a simple arithmetic product of rate and area, provided for convenience only, and is not a quotation.

Amenities described or depicted are those proposed or provided for the project as a whole. Their availability, specification, timing, and terms of access are governed by the project documentation and the rules of the apartment owners' association. Amenity images are representative. Amenities may be shared, may be subject to charges, and may be modified.

Distances and travel times to schools, hospitals, malls, stations and the airport are approximate, derived from publicly available mapping services, and provided for orientation only. Actual distance and travel time vary with route, traffic and mode of transport. Neighbouring landmarks are named for identification only and imply no association with, endorsement by, or benefit from those establishments.

8. Home loans and financial information

Any reference to home loan availability, bank approval or loan eligibility is general information, not a guarantee. Akarshana Infra is not a financial advisor, a lender, or an agent of any lender. Loan sanction is entirely at the discretion of the bank or housing finance company and depends on your own eligibility. Please take independent financial advice. Property values can go down as well as up.

You agree to use this Website only for lawful purposes, and specifically agree not to:

• submit false, misleading or third-party contact details through the enquiry form;
• use automated means to scrape, harvest or copy content or contact data;
• attempt to gain unauthorised access to the Website or its hosting infrastructure;
• reproduce, republish or commercially exploit any content without our written permission;
• use the Website in any manner that could damage, disable or impair it.

By submitting the enquiry form you confirm that you are at least 18 years of age and that the contact details you provide are your own or provided with the owner's permission.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability under the Real Estate (Regulation and Development) Act, 2016 or the Consumer Protection Act, 2019.

Disputes arising out of or relating to this Website or these Terms are subject to the exclusive jurisdiction of the competent courts at Bengaluru, Karnataka, without prejudice to any remedy available to you before the Karnataka Real Estate Regulatory Authority or a consumer forum.

We may revise these Terms at any time. The version published on this page at the time you access the Website is the version that applies.
